Risk Management – Chaperones

Chaperones play a crucial role in intimate examinations, offering support and reassurance to both the doctor and the patient. However, if a patient refuses to have a chaperone present, and you feel uneasy proceeding without one, what steps should you take?

Patients often decline to have a chaperone during examinations due to various reasons. The primary concern is the heightened embarrassment associated with having another person present during the examination. This is especially relevant for male patients when a male chaperone isn’t available at the medical facility. In cases where a female doctor is examining a male patient, there might also be hesitancy to have a second female in the room. In smaller or rural communities, the challenge of finding a suitable chaperone can be more significant. This could be due to a limited pool of clinical team members to choose from, or the patient may know the potential chaperone personally and wants to avoid causing offense.

The Guidelines

Within the fundamental guidelines of Good Medical Practice, the General Medical Council (GMC) states that doctors are obligated to deliver a high standard of practice and care. When engaging in the assessment, diagnosis, or treatment of patients, it is imperative to conduct necessary examinations.

If a doctor prefers not to proceed without a chaperone, yet the patient declines one, a clear explanation must be provided for the doctor’s insistence. Nevertheless, the clinical needs of the patient take precedence, particularly when urgency in examination is evident, overriding concerns about the absence of a chaperone.

“You may wish to consider referring the patient to a colleague who would be willing to examine them without a chaperone, as long as a delay would not adversely affect the patient’s health.”

What choices are available in such situations?

1.Understanding why a patient refuses a chaperone is crucial, as addressing their concerns may lead to a satisfactory resolution. For instance, concerns about the identity or role of the proposed chaperone should prompt efforts to find an agreeable alternative.

2. Consideration should be given to the timing of the examination. If not urgently required, alternatives like redirecting the patient to another local service or scheduling with a different doctor, possibly of another gender, should be explored. Addressing a problematic choice of chaperone could involve a delay in finding a more acceptable option. It is essential to confirm the patient’s willingness to wait and ensure they comprehend the importance of returning, as delays could lead to complaints, as illustrated in a recent case where a patient claimed unnecessary suffering due to delayed treatment.

3. If the decision is made to proceed without a chaperone and discomfort arises, stopping the examination, explaining the situation, and documenting the reasons are crucial steps. If necessary, arranging for the patient to be seen by a colleague becomes a prudent course of action.

Having professional indemnity insurance in place

Having professional indemnity is super important for doctors. It’s like a safety net when things get tricky, especially when patients say no to having a chaperone during exams. Professional indemnity helps doctors follow the rules and do their best for patients while staying protected.

When patients refuse a chaperone, it can be tough for doctors. Professional indemnity steps in to support them. It’s not just about doing the right thing; it also keeps them legally safe. This way, doctors can make smart choices, like explaining things to patients or even asking a colleague for help, without worrying too much.
